Agreement to Terms

By accessing or using Fold ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access or use our services.

These Terms apply to all visitors, users, and others who access or use the App.

Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Access and use the App for your personal, non-commercial purposes
• Create, store, and manage your personal productivity data

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Copy, distribute, or make the App available over a network
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the App without permission

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

• You are responsible for safeguarding your account credentials
• You agree not to share your account with others
• You must notify us immediately of any unauthorized access
• We reserve the right to suspend accounts that violate these Terms

User Content

Our App allows you to create, upload, and store content ("User Content"). You retain all rights to your User Content.

By using the App, you grant us a limited license to:

• Store and process your content to provide our services
• Back up your content for service continuity
• Display your content to you within the App

Subscriptions & Payments

Free Tier

Fold offers a free tier with core features. Free tier users can access basic task management, habits, events, and journal features.

Premium Subscription

Premium features are available through a one-time purchase or subscription:

• Payment is processed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are handled according to the respective app store's policies
• We reserve the right to modify pricing with reasonable notice

Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Fold and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written consent.

Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

• The operation or availability of the App
• The accuracy or completeness of any information
• That the App will be uninterrupted or error-free
• That defects will be corrected

Limitation of Liability

In no event shall Fold, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, or other intangible losses
• Unauthorized access to or alteration of your data
• Any other matter relating to the App

Our total liability shall not exceed the amount paid by you for the App in the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Fold and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the App will immediately cease
• You may request export of your data within 30 days
• We may delete your data after 30 days of termination

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified through:

• In-app notification
• Email to registered users
• Update to the "Last updated" date on this page

Continued use of the App after changes constitutes acceptance of the new Terms.
